Hi people I need some really urgent advise . Me and my mum both rented a property off someone who of course belived was owner , it turns out he was not given permission to sublet and the owner is aware , who confirmed he was never given permission. He had a deposit of 1200 ,which was not protected also , it was also over the 5 weeks amount rent , as the rent was 800 a month . There was also no gas safety checks , electric or energy performance certcicate . He also harassed us daily and was in the house every day sleeping and forcing us to work with no pay or threatened to be evicted at all times ( this was not in tenancy we had to do work ). We of course tried many many times to get another property , we finally managed to get away from him , ( he was arrested for modern day slavery and harassment but got away with it ) we have many videos and audio of his abuse . He then since leaving has put a court claim in for nearly 14,000 pounds including thousands of prohibited payment charges , charging us 200 a month in fees , even after moving out being charged ( we was not in a fixed term ) charged 5000 council tax even though we as included in tenancy , he is still carrying on with his claim and will never stop with his harassment . He also gave keys to another person who as going n the house every day , this is all when he was never even allowed to sublet the property in the first place . I am despair of it all as to the audacity of him .
If this is a real situation ( and not a fabricated scenario ) then it’s unlikely he will get anything in court.
I’m not sure what advice you seek but you seem to know the law well enough around deposits etc
Yes it really is , I am In no way making it up , it has been the worse thing I have ever dealt with . 5 years of his abuse it has been now , thr court claim has been dragging out nearly two years now . Police spoke to the owner of property and the mesnt tenant had no permission to rent and was seeking legal action but of course we wouldn’t be updated on such stuff .
I can not understand the sheer audacity for someone to carry on like it , even when he is told he wasn’t allowed to sublet and puts a claim in to the courts . There is even a charge of 2040 pounds for a section 8 notice ( we withheld rent for many reasons ) he was arrested broke his bail the very next day getting back in house and so much more ,which we paid and cleared every penny ( all confirmed to be withdrawn ) and trying to charge 2040 pounds for just a notice .
Preaction protocool letter also was at 11,000 odd then the claim he put in was nearly 14,000 also , it is just ridiculous .
You need free civil, legal advice. There should be a local Citizens Advice Bureau, in the main civil Court to your area. If you live in London, it is at Royal Courts of Justice. Take all the paper work you can muster.
I would make a crime report for extortion [online is much faster, than dialling 101] and if the Police are willing to take a statement from you, I would give the officers copies of your evidence.
The man or woman, sub tenants, may be doing it to a lot of people.
I would also report the person to local authority, because they might be willing and able to prosecute this person and get you a social worker, who could help you get re-housed by an housing association, or the Council, if their waiting lists are not too long.
Thank you , I have got some legal advice and they have told me that he will not stand a chance with his claim as he’ was never allowed to sublet , I’ve got the proof and when he was arrested the police also spoke to owner of property and I’ve got full confirmation that he had no permission to sublet and his lease prohibits sub letting , there are charges of over 5000 pounds in one part alone and many other prohibited charges , I’ve got to hope and prey the courts see him for what he is , as I have no faith in the justice system .ive been given somethint to write to him to discontinue proceedings but I bet he still carries on . He belives he can charge 16 pounds a week after three days . He is mad .
Not any gas safety checks , energy performance , protecting 1200 deposit and still not given it back , charging over 5000 council tax which was included in tenancy , he is literally mad . Moved out and gets people to follow me , take pictures of me , I’ve reported him so many times to police so many . They like to use the civil card all the time .
