I will be moving in to a new place soon. The landlord wants the rent on 28th of the month. I have no issue with this. The only issue I have is I will be moving in on the 5th of February, will the rent be prorated or will I have to pay a full month’s rent despite not moving in till 5th.
Previous places I’ve stayed always prorated the rent if I’m moving in in the middle of the month to align with the landlords rent due day.
You will need to ask your Landlord. He cannot charge you rent from 28th, if your tenancy agreement does not start until the 5th., or does it start on 28th, and you have just chosen not to move in until the 5th. Be sure about this, as you will be liable for utilities & council tax from the tenancy start date.
It seems she wants the rent on the 28th of every month but failed to state this on the ad or when I went for viewing despite mentioning several times that I will be moving in between the 5th and 6th February. Now she is saying I should pay on the 1st so it will be 28 days but it still doesn’t change the fact that I can’t move in till 6th February latest. I have already paid 150 holding deposit and passed necessary checks. I don’t want this to be an issue. What do you suggest?
Start the tenancy on 28th, and then move in whenever you want. You get the property you wanted.
Refuse to start the tenancy until the 5th. See what the Landlord does next. You might miss out, but if you do, I believe you have a good case for insisting the holding deposit is refunded in full.
Any charge for a period when you are not in occupation would be unlawful, so I would suggest a pro-rata’d payment from 5th to 27th and another payment on 28th.
