Not refunding the deposit money

Hello, I stayed in a resident at Birmingham during my visit. By contract they should return it in 7 days after my vacation.but it has been 3 months already. When I contacted the they initially they responded with random excuse and promised to return it in a week. But week after week they do the same thing. At one point they stopped responding at all. When I checked online it seems my deposit was not protected. Even when I asked about it they didn’t respond.

As I came back to India now I am completely helpless and feel devastated. Can anyone please share what to do in this situation?

Advice here:

Is this a AST property letting agreement, or a holiday short-term let?

Ok you say you stayed at a resident in Birmingham during your visit
1 do you mean you lived in a property in Birmingham when you were living in the UK? How long were you here for
2 did you rent the property through a letting agency or directly from the landlord
3 how long was the tenancy agreement for and did you stay the full time (this MAY have baring on why it hasnt been released to you yet)
4 did you give the correct and propper notice as per the tenancy agreement
5when you say they should refund it 7 days after your vacation…you do realise (and forgive me if this sounds condescending) that means 7 days after you leave the property not 7 days after a holiday (otherwise known as a vacation)

I stayed for around 40 days

Hi, I stayed for around 40 days and according to contract 7days after I vacate the property. It was through the letting agent in Birmingham. I don’t know whether it is ok to share the company name. Found them in spareroom.

Before I payed them I checked in the Google and found their company in gov.uk

I’m not sure anyone is going to be able to help, as we still do not know the basic info requested in the posts above.

Ok did you sign a contract or a tenancy agreement? And what was the end date ?

How much was the rent (per month)

How much deposit did you pay?

Did you receive notification that your deposit was held in a deposit scheme?

Why did you only stay 40 days?

Until these (and possibly more) questions are answered the experienced Landlords you need to answer your questions cannot help

Did you have a “Right to Rent” in England?
