I am renting out a flat with an AST ending on 4 May. I haven’t asked the tenants to leave but I have now decided that I am not happy to renew the contract. So I understand that the tenancy will become a rolling tenancy from 4 May. If I give them notice now, when would they have to leave by? (In the contract it mentions that if the tenants want to leave at the end of the tenancy period they have to give 2 months notice, but there’s no mention of what is to happen after that). Would they have 2 months after 4 May, so that the tenancy would terminate on 4 July?

You can serve a s21 notice now with a 2 month notice period. Allow a couple of extra days if posting. If the tenants dont leave when the notice expires, you will have to apply for a court order and bailiffs. This will take many months.

Ok I will talk to them first to make sure they would be ok leaving (we are on good terms). The 2 months period starts from the day they receive the notive (say I serve it tomorrow) or from the 4 May which is the date the next rent is due?
Weekends dont count so if you serve it tomorrow its 2 months from Monday, (plus 2 days if posting).
