I agree that if the property is completely uninhabitable, then the landlord may in some circumstances be able to claim that the contract is frustrated, but if they have a clause in their agreement stating that they will insure the property, which many will, then I think a court would expect more of the landlord and be less willing to release them from their contractual obligations.
