Right to rent check who pays?

Hi, who pays for the right to rent check? Can a tenant be made to pay for this check through an agency? Cheers? Paul.

No, the Tenant Fees Act means you can’t ask the tenant to pay for the R2R check or referencing. However, I would not recommend you leave the R2R check to an agency unless they sign a form to say they accept legal liability. Unless they do that, you remain legally liable with a maximum penalty of 5 years imprisonment. If you do the check yourself, there is no cost. You just have to ensure they have the required documents (check Home Office website) and then examine the documents by hand and take copies.
