Hi everyone, I found out a couple of days ago that my tenant has got 3 years. Only through word of mouth. I contacted the son who said his Dad had told him to clear it out. The son is not on the tenancy I have asked to meet him to do an inspection (it will need a ton of work and I wanted to get that lined up) I am being refused saying they don’t want anyone in there… I need to get a surrender signed but currently don’t know what prison he is in. Can the son refuse me access? What would you do please?
Yes, the son and tenant can refuse access. You are right that you need to get a deed of surrender signed. If the Son wont give you the name of the prison, try the Police. Visit him and take the deed with you. Ask a guard to witness.
Hi Leigh, ive had this a couple of times. If they are inside they aren’t going to be following the law too closely. Change the locks (because you dont want squatters) tell the son he can meet you there at a certain time in next two weeks to empty the stuff otherwise it’s going in a skip. take lots of photos and have a witness when you meet. keep anything valuable to return, cash, jewellery passports etc. If you have space consider storing it for 3 months. You need to take control of this. Scumbags interpret legal talk as weakness, dont mention deed of surrender to the son. Forget about getting more money from him just re rent it. Oh and if the AST is in the house get it and keep it. Dealing with the criminal fraternity needs a different skillset and many are uncomfortable in that area.
