Hi, I have a tenant that only moved in two months ago and signed for 12 month contract but suddenly they now wish to leave. What are my options?
My break up clause is nine months? Do I charge them a few months extra rent? What have you all done in the past? Just looking for a little bit of advice please?
If you agree with them leaving early, then they are liable for rent and utilities until you find a new tenant. Also liable for costs associated with finding a tenant.
Surrender of tenancy needed, again only if you agree. They have signed a contract, why on earth do so many think they do not need to honour it is beyond me.

If it is good reason make sure it’s evidenced and it’s not an excuse
I would tell them they will pay rent till the next tenancy begins , pay to cover your the cost of finding a new tenant ( advertising , viewings , etc cost money and I charge a months rent ) and cover with deed of surrender on departure
Make sure any cleaning cost or damage is deducted from the deposit
If your property is in Scotland and Scottish law applies? An end date on your contract is not valid. A tenant can leave anytime after giving you one month’s written notice. Appalling but there it is. So they can move in in May, give you one month’s notice a couple of days later and leave in June.
