Hi all, I wanted to reach out and gain advice on ending a lease with my tenant so that I can sell the property. The tenancy commenced in Nov 2024, updated Nov 2025 in line with new regs and I would like to terminate the contract at the end of Nov 2026. Can I just issue a Section 8 giving 3 months notice, coinciding with the end of the lease. Thanks all.
Firstly, there is no ‘end of lease’ date as your post suggests. You have a rolling contract which continues indefinitely.
Notice to sell a property requires a Section 8 & 4 months notice.
I would suggest you speak to an eviction specialist before doing anything to make sure you have ticked all the required boxes to ensure a smooth eviction.
No. Your contract became rolling from 1 may 2026. It has no end date
Tenancies can only be ended in 3 ways
I) tenant gives notice
2) court order following application for possession
3) mutually agreed surrender of the tenancy
If you serve s8 ground 1a (to sell) the notice is 4 months. If tenant doesnt move out tenancy continues and you have to apply for possession. Average times from application for possession to eviction by bailiffs were previously 8 months but I think timescales likely to have increased with a backlog of s21s served on 30 april
Get yourself an eviction specialist as the process is complex and if you get it wrong you have to start all over again
