If the 6 month fixed term tenant who has been served a notice to vacate 2 month prior. ie day one of 5th month to vacate at end of 6th month.
The tenant asks for extension to vacation date, will this not become rolling tenancy?
Will the landlord have to give notice again or can give extension date to vacate in one month ie end of 7th month.
Can one extend the tenancy by a month for the tenant ie move the vacancy date by one month. Is this acceptable. WIll it cause an issue? Thoughts please
If you have given notice, this is only a ‘request’ for them to move out and this does not end the rental contract. Therefore if the tenant does not move out by the end of the fixed term, it will roll into a periodic tenancy.
Assuming you have served the correct S8 or S21 notice, then you do not need to ‘enforce’ the eviction immediately, and can do so [I think within 6 months], so by that nature, their move out date can be flexible.
If the tenant does not move out, you will need to go to court for eviction.
As Karl says, your next step is to apply for a court possession order. Its quite an involved process, so if youre not confident of managing it alone, get some help.
