My tenant who runs a business here in uk decided to have surgery and chemo treatment for cancer back in his country in the next week. His wife who came here with a working permit last Jan24 will stay in the property whilst he will have the treatment abroad. The wife has renewable working permit only till Dec24. They wanted to end the agreement 3 months before agreed ending date and unhappy to continue to pay the rent till the end of tenancy but later they decided to keep the property and pay till contract will end in 19Oct24. If the husband main tenant dies or unable to come back before the tenancy ends and his wife who does not pay the rent because she was ‘added as an adult to occupy’ the property and works under his business. The question is : What are my rights as landlord and does she as wife have the right to collect the deposit from the DPS or do I have the right to give her the deposit if he dies and or decides not to renew the contract? The deposit is in the name of the main tenant only. Thank you

Does she automatically inherit his estate ?
I was under the impression that the spouse automatically inherits the tenancy ,named or otherwise .
I don’t always name spouses on contracts as I thought they had automatic right to the tenancy ( I cannot reference this though)
Does someone else have advice regarding this ?
under UK law, but if they were married overseas or are overseas nationals, that may not apply.
Plus if she is just here on a working permit and the business that she is working in has ceased trading (which if he passed away or was unable to return it would do) surely she has no right to remain
