What is the recommended date/time for conducting this - a day before, on the day or within a few days of the date that tenant vacates? All the above options are legally sound and defensible in case damages claimed are contested?
I usually do it after the tenant has left so that I can check everything at leisure.
I do it with the tenant at checkout… having already done a pre-checkout inspection so that there are no surprises for anyone involved. I’ve made many legitimate deductions in the past and not a single one has ever been challenged as this process ensures there’s agreement not only on what I’ll claim for but how much is reasonable.
My tenants are demanding that it be done after they have moved their stuff but in their presence ‘so that everything runs smoothly and to avoid any potential argument regarding the condition of the house’. They want to be present ‘until it is completed’. Am I supposed to comply or am I in my rights to reject such insistence and do it later?
I think it could lead to more arguments than it avoids. Youre not legally obliged to comply, but its probably best to allow it in case they try to use it against you later. In these circumstances I would suggest getting an independent Inventory Clerk to do the checkout inspection.
I can totally understand their fears and would encourage you to do it with them so that it does run smoothly if there’s no reason why you can’t. What would be your rationale for doing it later, especially considering any claim by you at that point is likely to be hotly disputed by tenants who have made such a request?
