I’m about to serve an eviction notice to my tenant who is in rent arrears and need to make sure everything is watertight at my end. My lawyer is asking if I gave the tenant the gas and EPC certificates at the start of the tenancy. I did not as I assumed everything was done by Openrent but I can’t find any details within my tenancy to show it was sent to him and on what date etc (which is what the lawyer wants to know). They’re also asking if I provided him with the Prescribed Information for the deposit protection scheme which again I did not and assumed Openrent did this. Please can someone let me know if these things will have happened and how I can find out what date they all happened on? Thank you!

I’m afraid we don’t serve the Gas Safety or EPC as part of Rent Now by default (only if instructed).

You can serve all those documents now, and the How to Rent booklet, before you serve the s21 notice and it won’t affect its validity just as long as the gas safety check was done before the tenant moved in.
It the deposit PI wasn’t served on the tenant then they could claim a deposit penalty against you through the courts.
