I have a studio flat that I have rented to my tenant since 2010. My estate agent was paid by the council directly, but 6 months ago all monies stopped.
After much investigation we have found out
The council has asked him to send a confirmation that he is still paying rent, he has not done so, and the council has stopped his rent payment; and so my rent has stopped. The council will not accept anything from me or the estate agent directly, and the tenant has refused to send any thing to the council. Instead he is insisting on a new contract from me.
I don’t want to do this as I would prefer to evict him at this stage ( he is a horder and has caused some issues in the flat).
I have written off the rent and just want him out. I am assuming he will need to be evicted by bailiffs. So may take up to a year ( no payment ) . Has anyone tried paying the tenant to leave, finding him new Universal credit accepting flat.
He is mainly concerned with being rehomed by the council. Can i assume if i evict him for non payment of rent he will not be re homed (as it is seen as being his fault).
He had been trouble and I’m financially in need of the rent but i also don’t want an old man on the streets.
Is there a way to find how the council works?
What i should do ?
He’s responsible for his own destiny. If he hasn’t paid rent for 6m, evict asap. No sentiment. You are running a business, and he is taking the ****

I feel for you but the reality is you are not running a charity.
The man won’t be on the street, but he also won’t be a priority for the council until he is actually evicted. Only then will they put him in emergency accommodation.
At this time as far as the council are concerned, he has a home so why would they pick up the tab for even more long term home.
I’ve been through this myself with my very first tenant. They redirected the payment and stole it… But the council rehomed them in a brand new housing association house ( that was even nice than the house I lived in)…and they kept the money.
Although I took them to the small claims court, I was awarded £5 a month… For a £3500 bill, and no, I didn’t even see a penny of that!
It might be worth contacting the housing people at your LA. Depending on where you are some are more amenable to landlords than others. FWIW I also considered using a financial incentive to get a tenant on benefit to move, but my solicitor advised me against it.
