I have a leasehold flat, after a few years of owning they added some flats to the roof, meaning an extra 7 flats shared the service charge. This didn’t involve a legal change to the percentage stated lease for my flats share, but the management companies, made the adjustments, in effect the budget was shared using 115% to account for the extra flats.
The problem I have is that I wasn’t on the ball, on one management co change (there have been 5) and they are using the figure on the lease, not the adjusted one. (despite the director of the company acknowledging the adjusted figure) This information didn’t make it to the account dept.
My question is do I have a legal right for the adjustment of service charge due to flats being added?
I would suggest you get a solicitor to write to them.
