My Lodger signed a Contract when he moved in that stated he should give me a month’s notice if he wanted to leave. However as he has been paying his rent weekly instead of monthly he says that legally he only has to give a week’s notice? Is he correct? Any advice appreciated.
He might be able to argue that if you just accepted the rent weekly, that the contractual obligation to give a months notice is superceded by the common law principle that the period of the tenancy, (and therefore the notice requirements) follow the rent frequency. Either way, its not worth arguing about. I suggest you accept the notice and move on.
