I have a difficult tenant. Their tenancy ends in March 2025. Can I issue a S21 notice now to end in March 2025, or will new rules apply if S21 has been abolished.
No one knows the future yet. There are policies / intentions to abolish S21, but no time frame for implementation will likely be known for months, nor will we know how this will affect S21 notices already served, until the legislative process progresses.
I don’t think Labour even know the answers as yet. The devil will be in the detail as and when the bill gets to parliament
So that’s 8 months in advance which is a long while. If we assume the fixed term on the TA expires in March 2025, then the earliest I believe you could serve a valid S21 would be sometime in Jan 2025. Happy to be corrected on that if I’m wrong. Never served an S21.
Also though, serving notice that far in advance is likely to deepen any rift between you and the T and make them even more difficult. It might be more helpful if we know exactly in what way you consider them difficult.
S21 notices time-out after 6 months, so if served now, it would expire in January.
Its likely to take over a year before any law banning s21 becomes law.
