Hey, I recently received a section 21 after we fell into arrears after a rent increase. These arrears have been paid off fully and the rent increased now for the next payment. At first I was all over the place however i’ve got myself moving and I’m now in place where I am applying for properties. However they all require references from my landlord/letting agency. I have been told by my letting agency that they would have to disclose the section 21, is this a legal thing do they legally have to disclose this? We have no arrears, rent has come out on time for the past 2.5 years (even though there was a slight under payment which is settled and we only fell into arrears in the past 3 months, rent was paid full and on time for 2 years before this) the property is in great condition and I’ve been told on both my inspections that they were really happy with how good we were. I just feel like this is going to seriously hinder my chances of finding onward accommodation and I really want to have a new place before we need to leave as I do not want a CCJ. I’ve rented for the past 10 years and I have never had this issue. Thank you for any advice!
Section 21 is a no fault eviction so if they reveal it, the section 21nin itself isn’t bad. But if they mean reveal the rental arrears or history of late payment, then this might be an issue for you. I hope a landlord on here can give you more insight. Good luck.
Thank you! I spoke with the director of the letting agency and he has said he would give me a positive reference as we have been excellent tenants up until that little blip. If I’m honest I don’t think it’s because we fell behind on our rent for those 3 months, I think she’s always wanted to be back in her home. She kept calling it her house and she came round to collect post and was very upfront saying she was considering at one point handing us out notice so she could move back. It’s a shame as we have loved living here but in the current market I understand why she would want to move back.

I am selling one place . Tenant started crying. Landlords feel under siege . Prediction …in 5 years housing needs are going to be far worse. Many landlords want out . Renting out commercials much easier
It’s such a hard time for both landlords and tenants at the moment. I honestly sympathise with both parties. Something needs to be done about this housing crises asap

Approach the letting agent as well as the owner and say how it is…
You can’t afford the rent increase but don’t want to fall into arrears. A negative reference will prevent you from moving.
The letting agent and owner will understand there’s a risk of you not paying the rent and having to spend thousands on evicting you… And they will act accordingly
I do hope you can find somewhere that you can afford. Regretfully life has been made so difficult for LL because of evil tenants and Government regs that are intended for rogue landlords but hit all. Unfortunately there is no protection for LL from evil tenants and the media portray all LL as greedy grasping and uncaring and all tenants as hardworking angels. Sadly the result is that LL are selling up in droves which means less and less properties available to rent. The biggest loser are the tenants especially the majority who are hardworking, respect their home and pay the rent on time.
Lets hope there is an improvement sometime soon, but unless the Government and the media stop bashing private landlords it is unlikely to happen.
Agree, I’m selling up and so is my partner… that is 60 beds we own between us. The Government, Interest rates with no breaks for us, Courts backed up and against us, Deposit schemes often against us, regulations are plain stupid - Council has told me to do some work to protect against fire… she is completely ill informed and ignorant in her opinion which is all costs added to the landlord despite her being totally incorrect. Dishonest agents, and no real remedies even from PR Schemes and Ombudsmen. Yes it’s the tenants who lose out as well as us landlords landladies hoping we could create a pension as I have no pension for various reasons. Landlord possession actions rise nationwide
Since Q2 2021, landlord possession actions have continued to rise in England and Wales. New government data reveals that possession claims have increased by 14%, possession orders by 12%, and warrants by 12%. Landlord repossessions in county courts have surged by 23% compared to the same period in 2022.
Between October and December 2023, 36% (or 8,522) of all landlord possession claims were from social landlords, a decrease from the pre-COVID majority of around 60%. Private landlord claims accounted for 31% (or 7,225) of the total, while accelerated claims made up 33% (or 7,635).
In the fourth quarter of 2023, there was a 12% rise in landlord warrants across all regions of England and Wales compared to the same period in 2022.
