Agree taking a deposit privately without using OR or a letting agent is more of a risk for a tenant and they need then to do more diligence (eg check LL actually is the owner). But same rules apply - legally LL cant keep if tenant is honest and doesn’t withdraw the application- see Shelter page

The landlord or agent might keep your holding deposit if you:

They cannot keep your money for any other reason.
For example, you should get your holding deposit back if you fail a credit or reference check, as long as you give honest information and facts about your situation. “
If the LL has kept your deposit without you withdrawing the application, get advice from Citizens Advice and Shelter
