Tenant served notice 22 October 2026 which is also rent payment day (they paid their October rent). They have advised they will leave by 22 November 2026. However, they have to give me two months notice which means that I am legally entitled to another rental payment to be paid on 22 November 2026 which also means that they could stay in the property until 21 December 2026 should they choose to leave then instead of November. Is this correct? When I select to end the tenancy on the openrent app, should the end date on openrent be 22 November 2026 or 22 December 2026? Not used openrent before I am misunderstood. Thanks.
Are you sure they have to give you 2 months notice? Have you read your tenancy agreement, as min 2 month notice only introduced for OR agreements signed after May.
They should give you notice compliant with the tenancy agreement. If they give you a shorter notice you can choose to accept it (but make sure all joint tenants agree), or reject it.
What reply did you send to their notice on 22 October?
The date you enter on OR is unimportant at this stage. Personally, I do not end on OR until tenant has actually moved out. This is just an administrative pre-cursor to being prompted to sort the deposit return. It has no legal affect on the tenancy.
What is important is your communication with the tenant and what you have, or are going to agree to.
@Iram_Naaz sort out whether you want to accept them leaving by nov 22 or dec 22. The rest on how you do admin on Openrent is easy do it after they have given you notice for a date you have agreed, maybe the day they actually have left
Bad idea holding people to extra month due to a single day - no wonder LLs get a bad rep. They dont want to be there why have folk in your property who dont want to be there who have tried to give you the correct 2m notice. Let them leave by nov 22, agree based on them giving reasonable access for viewings if you are lucky youll get a new tenant in before xmas
Good luck
Thank you for your reply.
Hello. The tenancy only started in May 2026 so the contract does state that the tenant must give no less than 2 month’s notice as per the new guidelines.
“Ending the Tenancy
The Tenant may end the tenancy by giving not less than two months’ written notice to the Landlord. The notice must end on a Rent Payment Day or the day before a Rent Payment Day.”
Tenant wants to leave by 22 November 2026 as they’ve found another property. I obviously can’t force them to stay another month. My question was just to ask advice. As a LL would you enforce the 2 month notice or just let the tenants leave? If they refuse to pay, to sue and pay legal costs for a month’s rent seems a lot. I am considering letting them leave and arranging viewings in the meantime whilst they are still at the property which means there won’t be a gap between this tenancy ending and the new one starting. I would usually ask my dad for advise on things small like this but he recently died and I was just reaching out to see what someone else would do.
In reply to your question about what I’ve accepted as a leaving date, I’ve just confirmed to the tenants that as per the contract they signed it’s 2 months notice. I’ve not confirmed any dates yet.
Sorry if it seemed like I was asking a super basic and stupid question but Thank you for replying.
Let them go, provided they assist 100% with viewings to help you find a new tenant. I’ve had tenants move out on a date, have check out inventory, cleaners, check in inventory and new tenants in that same evening. If you do this you will have to be upfront about minor repairs/redecoration. If you have a good relationship with the new tenant, this can be done.
You can state in your acceptance of their notice, that is reduced to 1 month, that does not comply with the 2 months notice terms of the lease that you accept this notice provided the exiting tenants can host viewings x amount of times a week until their departure. You can also include that the check out inventory and cleaning must be completed on the day they depart.
I wish my tenant had given me notice and left after 1 months notice, it is easier than the debacle I’m facing.
Yes. This does seem to be the most likely scenario. I’m just waiting for the tenant to confirm what date they will definitely be leaving so I can arrange everything. If they agree to paying the two months notice, stay or leave whatever they choose. I am awaiting confirmation! Thank you for your response and I hope it goes well with your tenants Lesley!
