Good afternoon. I am in a dilemma here with my tenants. I rented my property through Bairstow eves, introduction only. They found tenants and came back saying they passed credit check and ready to move. A husband wife and their 8 year old. We went ahead, and did not look at credit check (not sure we needed to). They moved in on 18th November. We went in on 26th November to say hello for the first time. It was a husband wife a 19 old son his girlfriend and a baby. Plus apart from bedrooms having double beds, including box room, they had a double bed in one of through lounges. When asked said wife had bad back so sleeps downstairs as bathroom is downstairs. Went back to agent to get the 18 plus adults on tenancy agreement. Bairstow chased with emails but nothing came back and later found son had moved out. In January we received a letter from council that property may need a HMO license. We went back saying that it was rented to a single family. February council called saying receiving complaints of too many people, loud music and fighting in the house. Went to see tenants, and arrived before said time to park up. Saw 3 people leaving before appointment time. Went in he showed saying no one living, but same condition beds in all rooms and one downstairs. When asked who lives here said him his wife and 2 sons, 8 and 13. Asked what happened to 19 year old and girlfriend, said they left. Discussed that we have complaints, he denied. Well kept on getting calls from council with complaints and complaints. Applied for license exemption. Also did research and found that he had advertised rooms on his Facebook. Gathered proof, Facebook advertisement plus complaints from council and created a section 8 and served. Rent wise he paid December, January February and not paying now from March after notice. Plus has not vacated property. We are stuck. We know we can go to court but we have heard it’s a long and tedious process. Thinking shall we higher solicitors who do guaranteed eviction. Please help.

Personally, given your lack of experience in this type of issue, I would consult with eviction specialists.
