Tenant wants to add wife to the tenancy agreement

Hello fellow landlords,

I have googled this topic: tenant want to add his wife to the tenancy agreement". Google result is mixed. Some says it is okay but others don’t think so.

I only checked on him and signed him up. He is EEA citizen, wife is still back home. Now wife and daughter is coming next week. He says his wife needs to be added to the tenancy agreeement so that they can apply for school place. Is that true? I asked him to tell school admission I allowed his family to stay in the house with him and willing to provide reference if she needs that.

She has differernt surname than his. So I guess they are not married. I haven’t seen their marriage certificate. Since she is not checking into the house. I haven’t seen any document about her. I have asked for her passport and relative document to prove she has right to rent. He told me his wife is on maternity leave for 2 years and will be financially depends on him. I replied his wife and daughter can stay in the house with him, but I am not comfortable to add her name on the tenancy agreement since she has no job to back her up yet. I understand if I need to evict them, I need to take both on court, not only him if I added both name on the tenancy agreement.

Is it safe to add her on the agreement?

His ‘wife’ will have a right to remain document/passport stamp if she is allowed to stay permanently. I am sure you could quickly ring the police to check her name against her status…

Don’t know about the rest of it but why would his wife need to be added for a school place? Children of single parents are still entitled to be schooled.
