Will Sec. 21 fail in hearing due to landlord address missing from old gas certificates

Can a bailiff order be set aside only because of the old gas safety certificates are missing the landlord name and address?

Thank you. This is so unfair. So, does it mean a tenant can remain in the property forever just because the certificates missing my address?! (I know the rules are changing and sec. 21 soon will be dismissed).

On another note, I have the confirmation from a barrister that I can add my name and address in the allocated box, and as long as I’m not touching ANY other information, it’s legally ok. Are you aware if this is correct?

@Shabnam4 you need legal advice on whether a correct current gas safety record served with an s21 would overcome this - think possibly it would.

It’s not unfair that LLs have to follow legal requirements correctly just like anyone else. You are trying to throw someone out of their home which is a serious matter so you have to do it properly.

Anyway there are lots of other potential grounds to evict so of course it doesn’t mean they can live there forever. It just means you have to do evictions properly and legally

I would tend to agree with the barrister that adding the name and address should be ok. You would then need to re-serve the gas cert today and re-serve the s21 tomorrow before 4:30pm. Make sure you have evidence of both.
