OR gas safety engineer omitted OR address

What about for the purposes of section 21?

@Dan4 but the legislation clearly says name and address needed and in this case the gas engineer hasn’t included an address.

1.Do you agree that was wrong and needs to be fixed, with OR arranging as gas engineer was OR’s contractor

Given the legal uncertainty @David122 highlights, can you confirm definitively that using ORs name and address will be accepted by courts and that OR is considered a lettings agent in the context of s21 and this requirement- do you have 100% definitive caselaw that LLs can cite if so please share.
  2. If not, why wouldn’t you simply tell all gas engineers to use the LL name and address not OR, to avoid any possible issues/doubt ?

I think that given the amount of time it has taken Openrent to respond and the short response given it still seems to be a grey area.

All lawyers take ages to respond especially if you aren’t paying for them and their contractors haven’t followed what’s legally required- what did you expect, an apology?

The gas safety certificate must include the name and address of the landlord or their agent. If it is missing the address then it should be amended to have the address included.

Given the lack of clarity about which agents can substitute for the landlord on the gas cert, I would reiterate my recommendation that landlords insist on their own details being inserted on the form rather than Openrents’. I would also suggest that Openrent now advise all their gas contractors to use the landlords name and address in future.

This may seem trivial given that the HSE almost certainly has no interest in taking action against landlords over this issue, and s21 will be ending soon. However, it now seems fairly certain that when the Government’s online landlord database goes live at the end of 2026, landlords will be required to upload all compliance certificates to the portal and invalid certificates may prevent landlords from evicting tenants.
