What does a landlord have to do when he sells with a sitting tenant on a periodic basis?

So, the landlord wants to sell the property with me as the sitting tenant - it recently failed the EICR test.

Does the landlord have to have the faults repaired before the house is sold or can it be sold without repairs being carried out?

If you are in it as a legitimate tenant the LL needs to have it compliant.

Nicely put Mr_T. Fines of up to £30k possible for non-compliant properties. If you are a legitimate tenant and intend to stay put, its worth having a word with your LL about getting the property compliant and quickly. The LL cannot serve notice on you whilst property is not compliant so you are on good ground and completing a section 21 eviction will take a least a year in current circumstances. If LL decides to play hardball, report them to the local council. Expect a swift resolution.

The fact that it might be sold is irrelevant. The landlord has 28 days from EICR report to rectify the faults, although its likely that the regulator would allow some flexibility.

@nilesh If the property’s not compliant, which means a S21 eviction would take a year at the moment, why is it worth getting the property complaint quickly?

David122 says that a failed EICR is meant to be rectified within 28 days to comply with the law regardless of whether it’s tenanted, being sold or otherwise.

Sorry. I should have been clearer. You do not want to live in a property with dodgy electrics. The LL is obliged to get the property compliant for EICR purposes. However, the LL may need some encouragement such as the potential for reporting to local council who could fine the LL up to £30k and force compliance if issues not put right within 28 days . In return, a scummy LL might attempt a revenge eviction using S21 (if now EICR compliant and all relevant + current ‘How to Rent’ docs served. By that stage you have approx one year to find a better home with a better LL. Make sense?
